INTRODUCTION

Patrícia Alexandra Teixeira Mendes, operating under the brand INDAGATIO, is a Portuguese company registered with the Commercial Registry Office of Porto under VAT number 236601474, with its headquarters at Largo Dona Maria Luiza Abreu Antas, 4940-522 Paredes de Coura, Portugal. 

GENERAL PROVISIONS

This document regulates the terms and conditions of use of this website and the agreement between INDAGATIO (the Merchant) and you, the User. These terms and conditions establish your rights and obligations, as well as those of INDAGATIO, regarding the goods/services offered on this website or any other website to which there is a hyperlink. These terms and conditions may be amended, so it is advisable to read them before placing any order. If you do not agree with these terms and conditions in full, you should refrain from placing any order.

ORDERS

To place an order, you must follow the online purchase process. Please note that this does not mean your order has been accepted. The order constitutes only a proposal to purchase one or more of our products. Any order is subject to the respective acceptance by INDAGATIO, which will always be confirmed by sending an email communicating the receipt of the order (ORDER CONFIRMATION), followed by another email confirming the shipment of the product(s). If the order is not accepted after any user account has been debited, the respective amount will be fully refunded.

The purchase and sale contract between the Merchant and you (CONTRACT) is only finalized upon communication of the SHIPPING CONFIRMATION. The CONTRACT covers only the products mentioned in the SHIPPING CONFIRMATION. INDAGATIO is not obliged to supply any other products that may be contained in the order until shipping is covered in another SHIPPING CONFIRMATION.

REFUSAL OF AN ORDER

INDAGATIO is not liable to you or any third party for the removal of any product displayed on this website, for the alteration or deletion of any materials or content on this website, or for refusing to complete the processing or acceptance of any order that has had the ORDER CONFIRMATION sent.

RIGHT OF WITHDRAWAL

Any User contracting as a consumer may freely terminate the CONTRACT within 14 days from the date of delivery of the product. In this case, you will be fully reimbursed for the amount paid, according to the provisions set out in the Return and Refund policy.

PRICES AND PAYMENTS

The prices displayed on this website include VAT (where applicable), but do not include delivery costs, which are added to the final price. Except in the case of an obvious error, the price of the products is as displayed at any time on our website. Although INDAGATIO strives to ensure that all prices shown on the website are correct, errors may occur. If INDAGATIO finds an incorrect price for a product in an order, you will be informed as soon as possible, giving you the option to confirm the order again at the correct price or to cancel it. If we cannot contact you, the order will be considered canceled, and you will be refunded the full amount of the order, if already paid. INDAGATIO is not obligated to supply any product at an incorrect (lower) price, even if a SHIPPING CONFIRMATION has already been sent, if the error was obvious, unequivocal, and should have been noticed by you under reasonable circumstances. 

INDAGATIO reserves the right to refuse orders of large size or quantity. All prices and quantities available may be changed at any time, but, except as mentioned above, this change does not affect orders for which a SHIPPING CONFIRMATION has already been sent.

PAYMENT METHODS

You can pay for your order by choosing any of the following methods (to be selected during the checkout process): Credit or Debit Card, PayPal, and Multibanco Reference and MBway (Portugal only).

All operations involving the transmission of personal or banking data are performed in a secure environment, on a server based on standard SSL (Secure Sockets Layer) security technology, and all shared information is encrypted. When paying with Visa or MasterCard, you will always be prompted for the following information: card number, expiration date, 3-digit security code (on the back of the card), and the name associated with the card. The order is processed and shipped after the details have been submitted to the bank and validated. The Card Verification Code (CVV) is a 3-digit number on the Visa®, Mastercard®, and Discover® cards. For American Express cards, it is a 4-digit number. The use of these numbers allows the online store to ensure an increased level of security in the transaction. Your order and card details are sent encrypted to the bank on the date of the order, using the highest security standard established by the PCI (Payment Card Industry) to protect cardholder details in web applications. All details are encrypted (SSL protocol). If a purchase amount has been fraudulently or improperly charged using a payment card number, the cardholder can demand immediate cancellation of the charge. However, if the purchase was effectively made by the cardholder and the request for refund is not due to the exercise of the right of withdrawal or termination and, therefore, the cancellation of the corresponding charge is improperly demanded, the person will be obligated against INDAGATIO to compensate for damages caused as a result of such cancellation.

To pay using PayPal, you must have or create a PayPal account. If you choose this method, you will be redirected to the PayPal page where you can log in or create an account to confirm the payment. Upon confirming the payment, your order is registered and ready to be processed and shipped.

RETURN OF DEFECTIVE ITEMS

If the User believes, upon delivery, that the received product does not comply with the CONTRACT, they should contact INDAGATIO at info@indagatiostore.com. The User should await a response from us with instructions on how to proceed. INDAGATIO will inspect the returned products and inform the User of the right to a replacement or refund (if applicable) by email, within a reasonable period. The analysis of the defective product and the corresponding refund (if applicable) should occur as soon as possible, within the legally established period of 30 days. Products returned by Users due to a defect, if confirmed, are refunded the full amount paid, including shipping fees and return expenses. The refund of any amount paid is always made using the same method used to purchase the product. These provisions do not affect any of the User’s rights under the law.
