CIVIL LIABILITY AND EXCLUSIONS

From the moment of delivery, all risks related to the supplied products shall be borne by the User. The ownership of the supplied products will only be transferred to the User when INDAGATIO receives full payment of the amounts due for the supply of the product, including delivery costs or after delivery, depending on which occurs last. INDAGATIO’s liability regarding any product purchased through this website is exclusively limited to the respective purchase price. In addition, the User is solely responsible for any liabilities, fees, and customs procedures or limitations on the purchase of specific goods arising from the legal frameworks and codes of conduct of the User’s country of residence.

ENTIRE AGREEMENT

These TERMS AND CONDITIONS and any documents mentioned herein constitute the entire agreement established between the parties regarding the creation of a CONTRACT and prevail over any prior written or oral agreement or understanding. Both parties acknowledge that, in entering into the CONTRACT, neither party has relied on any statement, commitment, or promise made by the other that could be considered implicit in something said or written in negotiations between the parties before entering into the CONTRACT, except as otherwise provided in these TERMS AND CONDITIONS. Neither party may rely on the fact that the other party made a false oral or written statement before entering into a CONTRACT (unless that statement was made fraudulently) and may only rely on the breach of contract resulting from these TERMS AND CONDITIONS.

CHANGES TO TERMS OF SERVICE BY SUPPLIER/LAW AND APPLICABLE COURT

The purchase and sale contracts of products through this website are governed by Portuguese law. Any dispute arising out of or related to these CONTRACTS is subject to the non-exclusive jurisdiction of the Portuguese courts. The provisions of this clause do not prevail over any of the User’s legal rights as a consumer.
